Use Case Name: Remote E-Notarization of Authenticated Electronic/Digital Signatures


Proposed New Use Case Template Category "Use Case Purpose": The purpose of this Use Case aligns with recent legislation from the Commonwealth of Virginia and the guiding principles of NSTIC in positing the Office of Notary Public internet access to offer national or state level web-based public acknowledgement. Notaries have been hindered in migrating online to offer their services in part due to retentive legislation, opinions, technology, training, and identity verification challenges. Public officials across the country have supported the argument that Notaries Public cannot effectively verify the identification documents of a potential signer online via camera or video. Or the integrity and security for a notarial transaction is subject to possible compromise due to an off camera or out of view threat, duress, or violent force levied against a signer or notary which is theoretically is inherent and without prejudice whether manual or electronic. However purposed in this Use Case are the implementation of the NSTIC guiding principles which allow trusted identity credential to integrate with real time interactive multimedia communication for verification of both identification documents and virtual presence of a signer and Notary Public. Embedded within the guiding principles of NSTIC are intrinsic benefits such as saving money, time, augmented accountability, reduce carbon emissions, and paper reduction. Yes in addition to trust, NSTIC is GREEN!

Additionally the guiding principles of NSTIC provide opportunity for a 21st century makeover for the Office of Notary Public and the very important role it fulfills. Notaries Public, devices, access, and most of all greater accountability may be enhanced with the trusted identity credentials. Signers seeking remote electronic notarization will be able to use their trusted identity credential for many transactions such as mortgage loan documents, legal documents, banking transactions, construction bids, affidavits for traveling children, board meeting notes, court documents, and much more. Notary Public's required to physically provide public acknowledgement, as an option, may now provide remote electronic notarial services effectively leveraging their trusted identity credential to provide signers with the level assurances for the respective type of notarization.


Use Case Description: E-Notary Public via a secure interactive real time video conference, provides public acknowledgement for a remote (not in the physical presence) signer's electronic/digital signature. E-Notary Public needs to verify a remote signers identity via signer's appearance and presentment of their required identification document supported by the signers trusted identity credential.

Use Case Details

Actors:

Goals: A signer who is remote (not in the physical presence) Notary Public (Relying Party) provide online remote e-notarization services for actor within approved trusted identity Eco system


Assumptions:Signer must physically appear in the presence of a Notary Public and present their identification documents or bona fides to receive notarization services.



Requirements: IDES approved Notary Public , Signer, and Devices


Process Flow: Signer (Actor) using their pre-registered IDES identification code is seeking Notarization of their electronic or digital signatures and electronic documents via access to a cloud based IDES pre-registered and approved remote e-Notarization SaaS system which facilitate online real-time meeting with a live Notary Pubic (Relying Party) via real time interactive multimedia video conferencing platform capable of recording, and verification of Signer identification documents. Signer (Actor) will use the required level for identification authorization. Signer (Actor) authentication attributes must meet required IDES pre-registered and approved remote e-Notarization SaaS system transaction attributes before transaction proceeds. Electronic signature platform allows for affixing of both Signer (Actor) and Notary Public (Relying Party) demographic information to electronic document and e-Notary Public Journal. Payment is made by Signer (Actor) via 3rd party payment solution. Payment approval grants release and sending via secure e-mail of secured encrypted linked of the notarized document to Signer (Actor) and other parties designated by signer for receipt thereof for download and printing (if necessary).


Success Scenario: Signer (Actor) uses required attributes for authentication of their identity. Notary Public (Relying Party) provides notarial services from distal/remotes locations. Electronic Record of the entire transaction is captured, archived, preserved.


Error Conditions: Signer (Actor) is unable to authenticate their identity or fails to have the required attributes to achieve identity authentication. System or transmission from multimedia platform fails causing communication disruptions. Electronic documents delivery fails. Electronic signature affixing fails.
